During the COVID-19 national health emergency, HHS has waived certain requirements to make it easier for providers to utilize telehealth services for providing care to patients while allowing both patients and providers to maintain social distancing.
Summary of Current State
• Waiver is in place for the duration of the public health state of emergency, allowing providers to use telehealth to conduct patient visits regardless of whether the patient is in a rural area
• Patients can be in their home during the visit, they do not need to travel to a healthcare location for the visit
• All three telehealth visit types (telehealth visit, check-in visit, and e-visit) are covered by the waiver
• Any type of visit that is appropriate to this method can be conducted through telehealth, and these visits do not need to be related to COVID-19
• ONC has stated that they will exercise enforcement discretion and waive penalties for HIPAA violations against healthcare providers serving patients in good faith through everyday communications technologies (such as FaceTime or Skype) during the COVID-19 nationwide public health emergency.
